QUESTION

My lawyer gave me false information that led to me accepting a settlement without proper information. Is this malpractice and/or can something be done

In March of this year I was in a car accident that resulted in very bad and long lasting soft tissue damage. I was a passenger and the woman driving in the vehicle I was in was at fault. Her insurance company is GEICO. Their initial offer was $12,000. I declined because of the fact that my medical bills were right around $12,000 (or so my lawyer told me). We then asked for $20,000 and they came back with $15,000. At that point I was almost certain I just wanted to take it to trial. I’m aware that soft tissue injuries are hard to prove but I also know that I’m in a lot of pain. I’m 17 years old, it’s been 9 months and I’m still bad off. But my lawyer convinced me that going to trial wouldn’t do me well so I accepted, thinking I’d get around $4,500 once doctor bills and the lawyers cut was taken out. And now suddenly my lawyer says that the doctors bills are more than $12,000 and admitted that someone in the firm was at fault for that and she says its too late for me to change my mind.

First, you have no business asking about such things on a legal website. You are a minor and have no say in the settlement of your case as this is controlled entirely by your parents - you are unfortunately NOT the decison maker at that level, so what you know or didn't know is not of consequence. That stated - your parents need to address any such concerns with the lawyer and go from there.
